Bork: Judges Deal a 'Dead Loss' for GOP

The deal with Democrats crafted by Sen. John McCain and six other Republicans is a "dead loss for the Republicans," Judge Robert Bork told Sean Hannity on Fox News' "Hannity & Colmes" show.

"They gained three judges and gave up four. And then there are others to come who will be filibustered. Also, the Democrats got a public relations victory. They are announcing that we pulled the republic back from the abyss, that we saved the whole country while the Republicans are standing around saying [nothing] but a little bit of this and a little bit of that."

When Hannity mentioned Sen. John McCain's role in the deal, Bork said: "Senator McCain is a war hero and we all honor him for that. As a senator, sometimes he is not as great as he was as a war hero, and this particular compromise, with McCain and [Sen. John] Warner in the lead, was a disaster."

Bork, who was the victim of a vicious smear campaign when he was nominated by President Reagan in 1987 to replace Lewis Powell on the Supreme Court, said, "What I care about is that the Democrats are trying to control the Supreme Court.

"They want a liberal, activist Supreme Court, which they have now ... a liberal, activist Supreme Court which is enacting the liberal agenda without anything in the Constitution to support it."

When Hannity compared the horrible things said about Judge Bork with those regarding Judges Pickering, Owen and Brown, Bork said, "The left is known for its lies."

When Alan Colmes complained that the Republicans, in trying to get rid of the filibuster, were simply trying to take away "a tool in the arsenal of the minority party," Bork shot back, "They wouldn't have taken it away if the Democrats hadn't decided they are going to control the court by hook or by crook.

"They are going to stop any nominee who agrees to interpret the Constitution according to the original principles - not the details, the principles. The Democrats don't want that."

Bork added that the Democrats "have clear rights. They can vote, but as the minority they are likely to lose. That's the way democracy works."

Regarding the atmosphere in Washington today, Bork said it "is more poisonous than it was when Richard Nixon was being forced from office. I've never seen anything like this."
