Harriet Miers Opposed Sodomy Ruling

Bush Supreme Court nominee Harriet Miers said in 1989 she was opposed to overturning the Texas State sodomy statute - something the Supreme Court eventually did with retiring Justice Sandra Day O'Connor supporting the majority.

According to the Associated Press, Miers was responding at the time to a survey by the Lesbian/Gay Coalition of Dallas.

Asked whether she believed, both as a citizen and a legislator, that criminalization of the private sexual behavior of consenting adult lesbians and gays should be taken out of the Texas criminal code, Miers answered no.

The Supreme Court struck down the prohibition on consensual homosexual sex in 2003 with its 6-to-3 ruling in the Lawrence v Texas decision. Justice Sandra Day O'Connor, whom Miers was nominated to replace, voted with the majority.

  Miers answered "Yes" to the survey question "Do you believe that gay men and lesbians should have the same civil rights as non-gay men and women?"
