The Florida Bar Association has opened a probe into alleged misconduct by Palm Beach County prosecutors in the case of top talk host Rush Limbaugh, who prosecutors accuse of engaging in "doctor shopping" to obtain too much pain medication for a bad back.
The Bar investigation into Florida State Attorney Barry Krischer was first requested last month by the Landmark Legal Foundation, a conservative legal watchdog group based in Herndon, Va., after Krischer's office made public portions of Limbaugh's confidential medical file without permission of the court.
Initially, the Bar told Landmark that it couldn't investigate Krischer because he's an elected official. But the legal regulatory group did an about-face this week after Landmark argued that Florida case law cited by the Bar did not apply to Krischer's case.
"Investigating this matter now protects the public, while neglecting to investigate would be a serious breach of the Bar's responsibilities," Landmark's president, attorney Mark Levin, told the Bar, in quotes reported by the Palm Beach Post on Thursday.
Announcing the Bar probe to his audience, Limbaugh said that his attorney, Roy Black, has heard from a number of law enforcement officials who are outraged over Krischer's conduct in the case.
"I've received a lot of e-mails from prosecutors, agents, police officers who are really somewhat embarrassed about what's going on here, and want to object," Black told Court TV's Catherine Crier on Wednesday.
"There's a number of prosecutors in Florida who have contacted me and asked me not to use their name, but who have said they just can't believe what's going on in Palm Beach County."
