One Reporter's Opinion: Eliminating Special Order 40

It is this reporter's opinion that there are many unsung heroes in the battle against the illegal invasion by those who would rob us of our precious sovereignty. The public interest group Judicial Watch is one such group of heroes, for they are now suing the Los Angeles Police Department to eliminate Special Order 40.

What is Special Order 40? Frosty Wooldridge, teacher and author of "Immigration's Unarmed Invasion: Deadly Consequences," tells us: "Daryl Gates, LA police chief in 1979, bowing to illegal alien immigrant advocates' growing power, introduced the order. Much like Lord Chamberlain's bowing to Hitler to preserve the peace for a 'moment' in history, the order prohibited officers from '... initiating police action where the objective is to discover the alien status of the person.'"

"As illegal alien migration grew," says Frosty, "so did its powerful advocates. The order was adopted by cities across America. Today, illegal alien criminals are free to move about the country in San Francisco, Chicago, Atlanta, New York, Denver, Phoenix, Miami, Detroit, Houston, Dallas and most other cities across the United States. Even if caught for a violation, one that could deport them before they commit a greater felony, they cannot be detained for immigration violations. Even though it is a federal offense!"

The Judicial Watch complaint states, "Special Order 40 and the policies, procedures, and practices arising thereunder are unlawful and void and the LAPD must be prohibited from expending any further taxpayer funds to enforce, maintain, or carry out in any manner the provisions of Special Order 40."

In its complaint, Judicial Watch cites the case of an illegal alien who went on a rampage, mugging three people, burglarizing two apartments and raping a woman in front of her 5-year-old daughter. The illegal had previously been deported for robbery, drugs and burglary, then made his way back into the U.S. Judicial Watch points out that although he had been stopped several times for traffic violations, the police were prohibited from reporting the illegal to immigration authorities and so he continued to roam free to murder and maim.

It has long been this reporter's opinion that there should be no constraints upon police officers when it comes to enforcing the law. And yet there still exist such ridiculous constraints in these so-called "sanctuary cities" as provided by an outdated order that is absolutely wrong for the post-9/11 world.

In 1979 such a constraint read in part: "Officers shall not initiate police action with the objective of discovering the alien status of a person. ... Officers shall not arrest nor book persons for violation of the United States Immigration Code." While originally well-intentioned, Special Order 40 has proved, throughout the years, to be dangerous and harmful to law-abiding citizens.

Adding insult to injury, in 1996 Congress enacted legislation that states, "A federal, state, or local government or official may not prohibit or in any way restrict any government entity or official from sending to or receiving from the INS information regarding the citizenship or immigration status, lawful or unlawful, of any individual."

There are hundreds of cases where police and sheriff's deputies have made simple traffic arrests that have ended up in the killing of the arresting officer. Two examples: Officer Donald Young of Denver [ http://www.thedenverchannel.com/news/4464046/detail.html ] and David March of Southern California [ http://www.freerepublic.com/focus/f-news/1130781/posts ]. In each case, the murderer fled to Mexico after seeking refuge in a "sanctuary city."

We commend Judicial Watch and its leader, Tom Fitton, for action long overdue to protect us from such violence; they are unsung heroes in our continuing battle against the illegal invasion of the U.S. by foreign nationals.

Local police and sheriff's deputies have suffered long enough under Special Order 40, and lives have been lost under this stupid restriction. But at long last, Judicial Watch is determined to remove the handcuffs from our local police forces so they can do their part in protecting us against the dangerous illegal alien criminals roaming our streets today.
