Abortionist Charged With Felony

A Michigan doctor is charged with felonious abortion for performing a third-trimester abortion on a healthy woman.
Wire services report that Dr. Jose Higuera is the first doctor in Michigan, and perhaps in the nation, to face criminal prosecution for performing an abortion since the Supreme Court's 1973 Roe vs. Wade ruling legalized abortion.
Michigan and 39 other states prohibit late-term abortions except to preserve the health or life of the mother, the Associated Press reported Tuesday.
"Had the mother's health been jeopardized by the pregnancy, there would not be a criminal prosecution," said state prosecutor Mark Blumer. "What we've got is the classic gray area," Blumer is quoted as saying.
"A woman went into the doctor's office and wanted an abortion for no good reason. And we have a doctor who was willing to give it. That's why this case is so different."
The woman said her marriage had ended and she did not want another child. Defense attorneys argue that Michigan law, written before Roe vs. Wade, technically bans all abortions and is therefore unconstitutional.
A trial date has not been set.
