Bay County Judge Rejects Exclusion of Absentee Votes

In a ruling that bodes ill for Democrat attempts to exclude absentee ballots in Florida's Martin and Seminole counties, a judge in the Florida Panhandle dismissed a lawsuit Thursday that alleged Republican misconduct in absentee ballot voting in Bay County.

Judge Ralph Smith in Panama City refused to reject nearly 9,000 votes for President-elect Bush and more than 3,000 for Al Gore. He said voters had done nothing wrong and the "sanctity'' of the ballots had not been compromised, the Associated Press reported.

A Bay County voter filed suit challenging a Republican mailing that featured a picture of Gov. Jeb Bush and a seal that resembled the Florida seal. The lawsuit said the mailing falsely indicated that the state officially encouraged absentee voting.

An appeal is expected.
